1. Introduction
1.1 Welcome to Kestrel View Studios. These Terms and Conditions govern your use of our website and services, including drone roof inspections, 3D tours, 2D plans, and drone photography. By using our website or engaging our services, you agree to these terms. If you do not agree, please refrain from using our services or website.
2. Definitions
2.1 "We," "us," or "our" refers to Kestrel View Studios and its representatives.
2.2 "You" or "your" refers to the individual or entity engaging our services or accessing our website.
2.3 "Service" refers to our drone roof inspection, 3D tour creation, 2D plan generation, drone photography or any other services we carry out.
3. Scope of Services
3.1. Drone Roof Inspections:
3.1.1 Our drone roof inspection service provides a visual overview of the roof’s condition, including observations on visible damage or wear.
3.1.2 The inspection is limited to areas visible to the drone. Obstructions such as weather conditions, physical barriers, or limited access may affect the scope of the inspection.
3.1.3 The report generated is not a formal survey and is not conducted to any specific industry standard. It is intended for informational purposes only and does not constitute professional advice.
3.1.4 All images contained within the reports are subject to the conditions outlined in 3.4 Drone Photography.
3.2. 3D Tours:
3.2.1 We create 3D tours of buildings and facilities to provide a virtual representation of the premises.
3.2.2 The tours are designed for visualization and informational purposes only.
3.2.3 All 3D photography is provided under a usage rights agreement. You are granted a non-exclusive, non-transferable license to use the images for personal, or commercial, purposes as agreed upon at the time of booking.
3.2.4 The usage rights agreement does not transfer ownership of the tours, videos or photographs. We retain all copyright and intellectual property rights to the photographs, videos and tours unless explicitly agreed otherwise in writing.
3.2.5 We reserve the right to use any photographs, tours or videos taken during the service for our own purposes, including but not limited to marketing, portfolio development, and resale.
3.2.6 Any use of the images beyond the agreed-upon rights, including resale or redistribution, requires our prior written consent.
3.3. 2D Plans:
3.3.1 As part of the 3D tour service, we may generate 2D floor plans of the premises.
3.3.2 While we strive for accuracy, we cannot guarantee that the dimensions or representations in the 2D plans are precise or suitable for design, construction, or other professional purposes.
3.4. Drone Photography:
3.4.1 We offer drone photography services to capture high-quality aerial images of landscapes, buildings, and facilities.
3.4.2 The images are provided for informational or marketing purposes and are not intended to serve as legal or professional documentation.
3.4.3 All drone photography is provided under a usage rights agreement. You are granted a non-exclusive, non-transferable license to use the images for personal or commercial purposes as agreed upon at the time of booking.
3.4.4 The usage rights agreement does not transfer ownership of the images. We retain all copyright and intellectual property rights to the photographs unless explicitly agreed otherwise in writing.
3.4.5 We reserve the right to use any photographs taken during the service for our own purposes, including but not limited to marketing, portfolio development, and resale.
3.4.6 Any use of the images beyond the agreed-upon rights, including resale or redistribution, requires our prior written consent.
4. Weather-Related Adjustments
4.1 Due to the nature of our drone-based services, weather conditions such as high winds, rain, or poor visibility may impact our ability to safely conduct inspections, photography, or 3D tour creation.
4.2 We reserve the right to reschedule services at short notice if weather conditions are deemed unsuitable or unsafe for drone operations.
4.3 If a service is rescheduled due to weather, we will communicate with you promptly to arrange an alternative date and time.
4.4 We are not liable for any inconvenience or delays caused by weather-related rescheduling.
5. Use of Reports, Tours, Plans, and Photographs
5.1. The reports, 3D tours, 2D plans, and drone photographs are intended to assist you in gaining a general understanding of the property’s condition, layout, or aesthetic value.
5.2. It is your responsibility to seek further professional advice or services if required.
5.3. These materials cannot be used as evidence in disputes, insurance claims, or legal matters without our explicit written consent.
6. Disclaimer
6.1. The services do not guarantee the detection of all defects, damage, or potential issues.
6.2. We are not liable for any decisions or actions you take based on the reports, 3D tours, 2D plans, or photographs.
6.3. The 2D plans are approximate and should not be relied upon for precise measurements or professional use.
7. Website Use
7.1. By using our website, you agree not to engage in:
7.1.1 Unauthorized access, tampering, or misuse of website content.
7.1.2 Activities that violate any laws or regulations.
7.2. We reserve the right to update website content and functionality without prior notice.
8. Booking and Payment
8.1. Bookings for inspections, 3D tours, 2D plans, or drone photography must be made via the website or approved communication channels.
8.2. For services quoted under £100, full payment is required prior to the service. For services quoted at £100 or more, a deposit of £100 is required at the time of booking, with the balance due prior to service hand-over unless otherwise agreed.
8.3. Cancellations made by you less than 24 hours before the scheduled service will incur a cancellation fee equal to 100% of the service cost or £100, whichever is lower.
9. Liability
9.1. To the fullest extent permitted by law, we are not liable for any direct, indirect, incidental, or consequential damages arising from:
9.1.1 Use of our website or services.
9.1.2 Reliance on the reports, 3D tours, 2D plans, or photographs.
9.1.3 Incomplete or obstructed inspections, visualisations, or images.
9.2. Our liability is limited to the amount paid for the service.
10. Privacy and Data Protection
10.1. We respect your privacy and handle your personal data in accordance with our Privacy Policy.
10.2. Images, data, and visualizations collected during the service may be retained for record-keeping, analysis, or training purposes but will not be shared without your consent, unless required by law.
11. Governing Law
11.1 These Terms and Conditions are governed by the laws of England. Any disputes will be subject to the exclusive jurisdiction of the courts of England.
12. Amendments
12.1 We reserve the right to update these Terms and Conditions at any time. Changes will be posted on our website, and continued use of our services indicates acceptance of the revised terms.
